A recent decision in Orlando imposed sanctions against in-house counsel for failure to preserve evidence, including email and laptops. Swofford v. Eslinger, Case. No.6:08-cv-Orl-35DAB (FL.M.D. Sept. 28, 2009). Many courts have imposed monetary sanctions against outside counsel of record for their negligence in working with their clients to preserve evidence.
