		<description>Thanks for the link.  Think the Food Lion case is helpful on the proximate cause issue, but just not sure on the unclean hands.  It would be a good argument to make, but at the same time ACORN didn't act inequitably with regard to the subject of the suit so I think it is stretching the concept a bit.  Still, there are so many angles of attack that you could throw a real kitchen-sink defense at the plaintiffs here.</description>

  Your previous analysis regarding actual damages I think is a hands down winner.  The argument was adopted by the district court in a very analogous case in Food Lion, Inc. v. Capital Cities/ABC, Inc., 964 F.Supp. 956, 959 n.2 (M.D.N.C.1997).
   Interestingly, Food Lion appealed this case on the issue of causation.  The Fourth Circuit did not reach the causation argument because it concluded that Food Lion could not circumvent the 1st amendment restrictions on defemation awards by seeking reputational damages based on a non-reputational state tort.  This holding based on Constitutional law and Supreme Court precedent is directly on point and defeats ACORN's request for reputational damages.    As an aside, I took a look at profiles of ACORN's attorneys.  They have some well-respected attorneys on their side.  I am curious what they may have up their sleaves.</description>
