Lawsuit in Suffolk work-status bill postponed
Thursday's hearing in the lawsuit seeking to invalidate Suffolk's worker status bill was postponed to May 29, attorneys in the case said.
Andrew Fiore, a Brentwood attorney representing Legis. Ricardo Montano (D- Central Islip), said State Supreme Court Judge Ralph Castillo ordered the parties not to discuss the reason for the delay. He said he remains confident Montano will win his case and have the bill returned to the Legislature's Consumer Protection Committee.
The worker status bill emerged from committee in April after presiding officer William Lindsay (D-Holbrook), who is an ex officio member of every legislative committee, cast the deciding vote in favor.
Montano has argued that Lindsay's vote could not have tipped the balance on the committee because Legislature rules require a majority of the committee members to pass a bill.
Lindsay has claimed that the rules require only a majority of the committee members who are present. Former Legis. Elie Mystal (D-Amityville) missed the meeting in which the vote took place. He later resigned after it was revealed he did not live in his district.
