Current Radio Program:

We discussed the conservative view of change within the criminal justice system with Pat Nolan. Nolan is the Director of the American Conservative Union Foundation’s Center for Criminal Justice Reform. Launched in 2014, The Center will inform and mobilize public support for criminal justice reforms based on conservative principles.

Nolan is a leading voice on criminal justice reform, highlighting the skyrocketing costs of prison, fiscal responsibility in the criminal justice system and reforms for non-violent offenders. He moderated a prominent panel on prison reform, featuring Texas Gov. Rick Perry that received widespread media attention. He is a leader of the Right on Crime project— a national movement of conservative leaders supporting reforms to the criminal justice system.

Pat Nolan served for 15 years in the California State Assembly, four of those as the Assembly Republican Leader. He was a leader on crime issues, particularly on behalf of victims’ rights, was one of the original sponsors of the Victims’ Bill of Rights (Proposition 15), and was awarded the “Victims Advocate Award” by Parents of Murdered Children.

Nolan was prosecuted for a campaign contribution which turned out to be part of an FBI sting. He pleaded guilty to one count of racketeering and served 29 months in federal custody.

Nolan is the author of When Prisoners Return, which describes the important role of the Church in helping prisoners get back on their feet after they are released. He is a frequent expert witness at Congressional hearings on important issues such as prison work programs, juvenile justice, prison safety, offender reintegration and religious freedom. He has lectured at many judicial conferences and legal conventions. He has coauthored articles for the Notre Dame Law School Journal of Law, Ethics and Public Policy and the Regent Law School Law Review.

Veteran’s Treatment Courts-NIC-Event on May 17

National Institute of Corrections Event on Veteran’s Courts on May 17. New Publication Available

Sentencing alternatives for veterans? There are dozens of specialized courts across the country that employ therapeutic programs to help keep veterans out of jail. “Veterans Treatment Courts: A Second Chance for Vets Who Have Lost Their Way” is a new publication that tells the story of these veterans and the judges, veterans advocates, and treatment professionals who are fighting to ensure a second chance for vets who find themselves caught up in the criminal justice system.

The publication was produced in partnership by the National Institute of Corrections (NIC), a division of the Federal Bureau of Prisons, and the Veterans Health Council of Vietnam Veterans of America (VVA). The report is based on a series of interviews and personal observations of the judges, veterans, and veterans advocates who have been intimately involved in the founding and operation of veterans treatment courts. In this book, they relay how veterans treatment courts are “the right thing to do” for justice-involved veterans who commit certain crimes associated with the lingering legacy of their wartime experiences.

Court staff and graduates of veterans treatment court programs describe, in often exquisite detail, what their roles are and how they have come to embrace the concept that these courts, which use a carrot-and-stick approach to rehabilitate rather than overtly punish veteran defendants, represent what one veteran in Buffalo, New York, a key player in the creation of the first of these courts in the nation, has called “the most profound change in the attitude of our criminal justice system towards veterans in the history of this country.”

Describe the inception of veteran’s treatment courts and their focus;

Highlight successes and challenges of veteran’s treatment courts; and

This publication was authored by Bernard Edelman, Deputy Director for Policy and Government Affairs, VVA; and consultant Dr. Tom Berger, Executive Director of VVA’s Veterans Health Council.

We interviewed Micki Trost, Strategic Communications Director, and Sara Spaulding, Communications Specialist, for the Colorado Division of Homeland Security and Emergency Management regarding Colorado’s implementation of a Virtual Operations Support Team (VOST).

A basic premise of emergency media operations is the understanding that there may be millions of social media messages created during an emergency. It’s understood that the volume of messages, calls for assistance, erroneous information, or malicious websites could hamper the provision of vital information, or impede analysis, correct messaging or recovery.

A Virtual Operations Support Team is composed of vetted and trained social media specialists who analyze and report critical information regarding an emergency to spokespeople at an emergency media command center. VOST members can be in-state, or reside throughout the United States or the world.

We interviewed Thomas Abt about reducing violence. Thomas Abt is a Senior Research Fellow and Adjunct Lecturer in Public Policy at the Harvard Kennedy. Both in the United States and globally, Thomas teaches, studies, and writes on the use of evidence-informed approaches to reducing gun, gang, and youth violence, among other topics.

Before joining Harvard, Thomas served as Deputy Secretary for Public Safety to Governor Andrew Cuomo in New York, where he led the development of New York’s GIVE (Gun-Involved Violence Elimination) Initiative, which employs evidence-informed, data-driven approaches to reduce violence. Before New York, Thomas served as Chief of Staff to the Office of Justice Programs at the US Department of Justice, where he played a lead role in establishing the National Forum on Youth Violence Prevention, a network of federal agencies and local communities working together to reduce youth and gang violence.

Current Radio Program:

There has been significant change in juvenile justice policies and trends throughout the last decade. To summarize and explain this transition, we interviewed Jake Horowitz, the policy director for the Public Safety Performance Project at The Pew Charitable Trusts. Jake oversees Pew’s work to advance data-driven, fiscally sound policies and practices in the criminal and juvenile sentencing and corrections systems that protect public safety, hold offenders accountable, and control costs.

A growing body of research demonstrates that for many juvenile offenders, lengthy out-of-home placements in secure corrections or other residential facilities fail to produce better outcomes than alternative sanctions. In certain instances, they can be counterproductive. Seeking to reduce recidivism and achieve better returns on their juvenile justice spending, several states have recently enacted laws that limit which youth can be committed to these facilities and moderates the length of time they can spend there. These changes prioritize the use of costly facilities and intensive programming for serious offenders who present a higher risk of reoffending, while supporting effective community-based programs for others.

Before joining Pew, Jake worked at the National Institute of Justice (U.S. Department of Justice), in the U.S. House of Representatives, and at Eckerd Youth Alternatives. Jake graduated from Reed College and Harvard University’s Kennedy School of Government

Predicting risk of criminal offending through risk instruments is integral to our understanding of change in the criminal justice system.

We interviewed Mason Burley, Senior Research Associate for the Washington State Institute for Public Policy (WSIPP), and Zachary Hamilton, Assistant Professor, Department of Criminal Justice and Criminology, and Director of the Washington State Institute for Criminal Justice, Washington State University.

We discussed a new report from WSIPP and the larger policy implications of risk instruments. The title of the report is, “Assessing the Risk of Criminal Offense for Washington’s Involuntary Treatment and Forensic Commitment Populations,” which included an assessment of a risk instrument for mental health and convicted populations.

We interviewed Clifford T. Keenan, the Director of the Pretrial Services Agency for the District of Columbia. Cliff is a nationally known expert on pretrial operations.

The Pretrial Services Agency for the District of Columbia (PSA) has served the Nation’s Capital for more than 45 years with the same important mission: to promote pretrial justice and enhance community safety while honoring the presumption of innocence and each defendant’s right to pretrial release under the least restrictive conditions.

Washington DC is unique in that it is one of the very few jurisdictions that does not use money as a condition of pretrial release. There is no commercial surety taking place, so there are no bail bondsmen operating in DC. There are no persons being detained at the city’s jail because they do not have the money to post “bail,” unlike most other jurisdictions around the country.

PSA is very proud of what the agency has accomplished in nearly half a century of operation, particularly through the development of innovative programs and technologies that distinguish PSA as a leader in the pretrial field. Some of our innovation highlights include:

Being among the first criminal justice agencies in the nation to develop an automated criminal history database;
Being the first pretrial program to introduce on-site drug testing of defendants;
Introducing a state-of-the art paperless barcoding system for drug testing results, which laid the foundation for a comprehensive electronic system that allows judicial officers to access drug test results and detailed chronological records of defendants’ progress in supervision and treatment;
Launching the D.C. Superior Court Drug Intervention Program – better known as Drug Court – in partnership with the Court and U.S. Attorney’s Office, to provide intensive treatment and graduated sanctions for all defendants in need of substance use disorder treatment;
Collaborating with the D.C. Superior Court to establish one of the first mental health community courts in the United States and to be the first jurisdiction to expand its community courts across the entire city.

Veterans Treatment Courts are one of the fastest growing criminal justice programs in the United States. Since 9/11, more than 2.5 million Americans have served our country in uniform. Many of them have deployed several times. And many of these men and women in uniform are coming home and struggling not only with the physical wounds of war, but also its “invisible” wounds: post-traumatic stress disorder and traumatic brain injury.

Since the inception of the first Veterans Treatment Court by Judge Robert Russell in Buffalo, NY in 2008, there are now more than 300 veterans treatment courts across the country. These courts account for veterans’ military service and provide diversion and treatment alternatives specific to their needs.

The development of a screening tool specific to veterans is now underway through partnership between the National Institute of Corrections (NIC), the Bureau of Justice Assistance (BJA) and the Center for Court Innovation (CCI). The assessment tool factors in the latest research on trauma and will support an accompanying case planning protocol. This Veterans Treatment Court Enhancement Initiative is a three-year project that will include implementing the tool and protocol in two pilot sites. The pilot site solicitation opportunity will be released in November 2015.

Current Radio Program:

Sidney Davis is a former offender who is now a leader within the reentry and larger community in Washington, D.C. He is employed as a bus driver; he is running for election as president for his local transit union.

Sidney’s transformation has been chronicled by a variety of media sources, including the Washington Post. Columnist Courtland Milloy in 2013 wrote: “While riding a Metrobus recently, I watched the driver help a blind man find a seat, then help him off the bus, wave oncoming traffic to a halt and escort him — arm in arm — to the other side of the street.

It was a common courtesy made remarkable because the driver was Sidney Davis, whom I’d first met in 1981 when he was an inmate at the Lorton Correctional Complex. He was nine years into a 20-years-to-life sentence for murder.

“God granted me freedom so I could help others,” said Davis, 66, after returning to the bus.

John Roman is a Senior Fellow at the Justice Policy Center of the Urban Institute. John addresses the lessons of social impact bonds and more importantly, their impact on criminal justice policy and the delivery of services to underserved populations.

From John’s article in the Huffington Post: “Results from the first generation of social impact bonds (also known as pay for success deals) are starting to come in. Today, the field has learned the results of the evaluation of the first social impact bond transaction in the United States.”

“The investment by Goldman Sachs and Bloomberg Philanthropies in a program to serve young men at the Rikers Island jail — the main processing and housing facility in New York City — did not show a sufficiently positive effect to warrant the continuation of this intervention. The program will terminate at the end of August.”

“While the results seem to be a defeat for this approach, we see them as a partial victory for this disruptive innovation. Here’s why: The goal of pay for success deals is to encourage private investors to fund proven social programs by providing upfront support to programs that seek to improve long-term outcomes for those in need. If the programs are successful, governments pay the investors back; if they are not, then the investors absorb the cost, and governments pay nothing.”

It’s possible that the most important part of the discussion is the process where the private sector and government join forces to provide services and the implications joint operations imply. John suggests that this model could a fundemental point of change for criminal justice and government operations and deserves discussion and consideration.

Current Radio Program:

Thomas Abt is a Senior Research Fellow at the Harvard Kennedy School of Government, where he teaches, studies, and consults on the use of evidence-based approaches to violence reduction, among other topics. Previously, he served as Deputy Secretary for Public Safety to Governor Andrew Cuomo in New York and as Chief of Staff to the Office of Justice Programs in the U.S. Department of Justice.

The podcast addresses violence reduction. Abt believes that violence in America can best be understood and reduced by focusing on specific people and places, rather than an overbroad approach to an entire community. He also emphasizes legitimacy and procedural justice in order to promote community collaboration and interagency cooperation. Abt draws from his experiences in New York State and the U.S. Department of Justice, and has authored, among other publications, “Integrating Evidence to Stop Shootings: New York’s GIVE (Gun-Involved Violence Elimination) Initiative,” discussing New York’s approach to reduce gun violence and providing guidance to similar initiatives.
