In a recent case, Alabama’s supreme court considered an Alabama truck accident case in which the jury found in favor of the plaintiff after a woman was killed after colliding with a tree on the side of an Alabama road.

The Trial

According to the plaintiff’s complaint, the plaintiff alleged that two employees of the defendant’s company were driving separate dump trucks when one of the trucks caused the woman’s truck to leave the road, where she collided with a tree and died. The woman’s estate brought a lawsuit against the employer, based on the negligence of either of the employees.

At trial, a witness testified that on the day of the crash, a white dump truck passed him traveling in the opposite direction, that the white dump truck operated by the defendant’s company was not entirely within its lane, and that he had to move over to allow the truck to pass safely.

Another witness stated that he saw a white dump truck traveling toward the dump site. Both witnesses testified that there was no car crashed into the tree when they passed the spot where the woman’s car was later found. They testified that another driver who was traveling behind them called and said that he saw a car against a tree when he passed that spot. One of the witnesses said he only passed one white dump truck, but the other said that he passed the white dump truck and a black truck, also owned by the defendant. Another witness testified that he saw a white dump truck force the woman’s vehicle off the road because it was not in its lane. Each of the defendant’s two employees who had been driving dump trucks on the road at the time testified that they were driving toward the dump site and saw the woman’s car against a tree. Both employees stated that they did not cause her car to leave the road.

The woman’s estate claimed that the woman’s death was proximately caused by one of the defendant’s drivers. The defendant claimed that there was not sufficient evidence to prove that the woman’s death was proximately caused by one of its drivers because there was no evidence showing that one of its employees’ trucks forced the woman’s car off the road. After the end of the trial, the jury found in favor of the woman’s estate and awarded the estate $2.5 million.

The Appeal

The defendant argued the verdict should be reversed because the defendant was entitled to a judgment as a matter of law. Yet the court found that the testimony presented was sufficient to allow the jury to conclude that the woman was forced off the road by a white dump truck. In addition, the only dump truck in the area at the time that fit the description was one driven by a driver employed by the defendant. However, the court ultimately ordered a new trial because the defendant only learned of the eyewitness’ testimony at the last minute, and it found the court should have granted a continuance before proceeding with the trial.

Judgment as a Matter of Law

A party can move for a judgment as a matter of law under Alabama law to receive a judgment from the court without the jury’s verdict. A trial court has to determine whether the evidence is sufficient to submit a question of fact to the jury. To submit a question of fact to the jury, there must be “substantial evidence” before the jury to create a question of fact. Substantial evidence is defined as “evidence of such weight and quality that fair-minded persons in the exercise of impartial judgment can reasonably infer the existence of the fact sought to be proved.”

After a jury has returned a verdict in favor of a plaintiff in an Alabama personal injury case, the jury will then determine the appropriate amount of compensation that the plaintiff should be awarded. This compensation is called “damages.” In Alabama, there are two types of damages awards that a plaintiff can recover: compensatory damages and punitive damages.Compensatory damages are designed to put the plaintiff back in the place they were before they were involved in the incident. Categories of compensatory damages include medical expenses, lost wages, and compensation for any pain and suffering endured as a result of the accident. In general, there is no limit to the amount of compensatory damages that a plaintiff can recover.

The Facts of the Case

The plaintiffs were injured in a car accident that they claimed was the fault of the defendant, who was drunk at the time of the accident. The plaintiffs filed an Alabama personal injury lawsuit against the defendant, and, after a jury trial, the plaintiffs were awarded both compensatory and punitive damages. The defendant appealed the award of punitive damages, claiming that they were excessive.

On appeal, the court affirmed the punitive damages awards. The court explained that it considers several factors when reviewing a punitive damages award for excessiveness. Specifically, the court looks at:

• The reprehensibility of the defendant’s conduct;
• The disparity between the actual harm suffered by the plaintiff and the punitive damages award;
• The award in relation to the awards in other comparable cases;
• The defendant’s profit from his misconduct;
• The defendant’s financial position;
• The cost of the litigation;
• Whether the defendant has been subject to criminal sanctions for similar conduct; and
• Other civil actions arising out of similar conduct.

Here, the court determined that the only two factors that applied were the reprehensibility of the defendant’s conduct and the defendant’s financial position. The court also explained that the reprehensibility of the defendant’s conduct was the most important factor and should be afforded ample weight in the analysis. The court also noted that the trial court had reasonably determined that the defendant was not a credible witness regarding his own financial situation, and it afforded his testimony no weight.

As a result, the only factor the court was left to consider was the reprehensibility of the defendant’s conduct. The court determined that given the fact that the defendant was voluntarily intoxicated at the time of the accident, the punitive damages award was appropriate.

Being an emergency responder is a dangerous job for a number of reasons. However, the leading cause of death among emergency responders has consistently been traffic-related accidents. A driver’s failure to follow the state’s move-over law will result in a misdemeanor conviction and may also be a basis for civil liability.

Woman Charged with Tow Truck Driver’s Death

Earlier this month, a grand jury returned an indictment charging a Tuscaloosa woman with criminally negligent homicide for her role in a fatal accident that took the life of a tow-truck operator back in 2016. According to a local news report, the truck driver was working at the scene of an accident near mile-marker 74 on Interstate 20/59 at the time of the collision. Evidently, the woman was traveling in the lane closest to the accident, and she struck one of the vehicles involved in the accident. That vehicle then spun around and struck the tow-truck driver. He was taken to DCH Regional Medical Center, where he was pronounced dead a short time later.

Since the accident, the family of the tow-truck driver has advocated to increase the penalty for those who violate the state’s move-over law. As it currently stands, the penalty for a first-time offender is only $25.

That being the case, the fact that a motorist violated the move-over law can help an accident victim or their family establish liability in a civil case against the at-fault motorist through the doctrine of negligence per se. Under this doctrine, a driver is presumed to be negligent if they are in violation of a statute that is designed to protect the very class of person who was injured in the accident. For example, move-over laws are specifically designed to protect emergency workers, so an emergency worker who was struck by a motorist who failed to change lanes may be able to benefit from this legal doctrine. In fact, since the standard is different in civil and criminal cases, victims may have an easier time proving a case of abuse in civil court. Additionally, the rules of discovery in a civil trial allow for plaintiffs to obtain much more information from the defendant, potentially helping the plaintiff prove their case.

Earlier this month, the United States Senate unanimously passed a bill that revamps the compensation available to victims of child pornography. According to a recent news report, the Senate Bill makes several changes to the amount and types of compensation victims of child pornography can receive from those responsible for the abuse.

Senate Bill 534, named “The Protecting Young Victims from Sexual Abuse and Safe Sport Authorization Act of 2017,” amends the current statute that provides for compensation in cases of child pornography. The bill proposes the following changes:

• Provides victims with a choice between either “actual damages” or $150,000 in liquidated damages;
• Increases the type of attorney’s fees that can be recovered by victims;
• Allows courts to award punitive damages to victims of child pornography;
• Extends the current statute of limitations to 10 years after the victim turns 18 years of age;
• Provides victims with a 10-year statute of limitations from the date when the victim “reasonably discovers” the pornography; and
• Allows for lawsuits to be more easily filed in federal courts.

The bill also requires that amateur athletics governing bodies report allegations of sexual abuse to state or federal law enforcement officials. Additionally, the bill provides an avenue for aspiring Olympic athletes to report instances of sexual abuse.

Before the bill becomes law, it will have to be signed by the President. It is expected that the President will sign the bill shortly.
