I had a waiver client who got her card proving her status from the Government of Canada. 
&lt;/p&gt;
&lt;p&gt;
Today, she went to the border to ask if she need a new waiver, or if she could cross.
&lt;/p&gt;
&lt;p&gt;
They told her she must fill out a "Quantum Form" so I did some research. 
&lt;/p&gt;
&lt;p&gt;
 Under U.S. law (8 U.S.C. § 1359) and the Jay Treaty, Canadian-born Indigenous people with at least 50% blood quantum have the right to freely enter, live, work, and study in the United States without a visa. To claim this status with U.S. Customs and Border Protection (CBP) or Homeland Security, individuals must prove their blood percentage.
&lt;/p&gt;
&lt;p&gt;
Required Documentation
&lt;/p&gt;
&lt;p&gt;
U.S. authorities do not rely on a standard Canadian status card alone to grant permanent work or residency rights under the Jay Treaty. 
&lt;/p&gt;
&lt;p&gt;
Acceptable proof typically includes:Blood Quantum Letter:
&lt;/p&gt;
&lt;p&gt;
 An official statement or ancestry letter on band/tribal letterhead, or from Crown-Indigenous Relations and Northern Affairs Canada (CIRNAC), explicitly stating a blood quantum of 50% or higher based on official genealogical records.
&lt;/p&gt;
&lt;p&gt;
Long-Form Birth Certificate: Showing lineage connecting to parents/grandparents with verified status.
&lt;/p&gt;
&lt;p&gt;
Secure Certificate of Indian Status (SCIS) or photo ID.
&lt;/p&gt;
&lt;p&gt;
WHTI-Compliant Travel Document: Such as a valid passport if arriving by air.
&lt;/p&gt;
&lt;p&gt;
Basically in Canada, your blood % does not matter. In the US it has to be seen as 50% or greater.

I have a waiver and my spouse has a Nexus Card.
&lt;/p&gt;

Spouse did not use Nexus Card and used passport to enter with me.
&lt;/p&gt;
&lt;p&gt;
Came to secondary with me which was optional, could have just entered but waited with me&lt;br /&gt;
Did not need to surrender passport while i was in secondary screening 
&lt;/p&gt;
&lt;p&gt;
I went and did my thing and was told all good to go. Gave me back my waiver and passport and a small piece of paper.  Which I required to leave secondary 
&lt;/p&gt;

That was it

You do not appear to pay the 6 dollar fee any longer. At least for air travel.

Looked online and found the I94 is good until January 2027.

Still had time before traveling to USA to enter the Maple Leaf Lounge 
&lt;/p&gt;

Just to give you more context, this question is an important one and I will explain why. 
&lt;/p&gt;
&lt;p&gt;
Before THIS Trump term, you HAD to put on your waiver application "in the future I may also want to apply for a TN/O/E Visa if you planned to apply for one once your waiver was granted. 
&lt;/p&gt;
&lt;p&gt;
We know this because I had MANY clients who had 5 year waivers, and when they would try and apply for these visas, they had to get a brand new waiver with this designation.  
&lt;/p&gt;
&lt;p&gt;
I have a friend who works for Homeland Security (he now works in Hawaii but used to work at Pearson and trained with me in MMA)  and he explained it this way.  When they are considering your waiver application, the fact you MIGHT want to apply for a VISA is important in their consideration.  Many clients I have are doing waivers not because of criminal records, but for things such as "applying for asylum-application rejected"  "misrepresentation" and "overstaying" as well as "working illegally".   If you apply for a waiver and do not tell them your intentions, they may have given you a waiver for a shorter period for example. 
&lt;/p&gt;
&lt;p&gt;
Now, they have changed this again.  Instead of simply ignoring the "I may wish to apply for____ in the future" or adding it to the waiver, they STOP the application, and ASK, "do you want the waiver?  Or should he close the file so you can apply for the Visa?"
&lt;/p&gt;
&lt;p&gt;
This makes no sense, since if you are INADMISSIBLE, you cannot get a visa, you cannot even VISIT.  The waiver "waives" your inadmissibility. 
&lt;/p&gt;
&lt;p&gt;
Anyways, this is the REAL reason this has come up.   My advice?  Since they are making it difficult to get these Visas anyways, and since 80% of 1st waivers are 1 year anyways, just apply for the waiver, and then hopefully if you get an opportunity to apply for a TN visa or any other visa, just apply separately.

<title>NEXUS CARD HOLDER DENIED</title>

I have a new client, he had a Nexus card.  He had a bad reaction to the Johnson/Johnson shot, and went from healthy, to autoimmune "hell".   
&lt;/p&gt;
&lt;p&gt;
Medicine in Canada found no solutions, so he found a clinic in Tampa doing experimental treatments, and it has changed his life.   He ONLY travelled to and from this clinic.  No vacations, no holidays.    He is getting slowly better and can now walk.  He is only 61....former high level hockey player. 
&lt;/p&gt;
&lt;p&gt;
He got confronted by Homeland Security, and they said that it appears he overstayed.  He showed them all the paperwork, all the visits, and yes, he had overstayed.  
&lt;/p&gt;
&lt;p&gt;
He also needs to go to another appointment/treatment later this month, and in August. 
&lt;/p&gt;
&lt;p&gt;
Of course they revoked his Nexus, denied him entry, and basically told him to go back to Canada and die there.  (this was a woman officer) 
&lt;/p&gt;
&lt;p&gt;
Now he is my client, and I have had experience with a client who went for experimental Cancer treatment.   In his case, he was in his 30's and he looked terrible when he was referred to us.  In his case, it was a minor criminal record. 
&lt;/p&gt;
&lt;p&gt;
In the case of that gentleman, we applied for the Waiver, and, knowing it would not arrive in time, immediately did a Port Parole.  They granted it, but warned that "this would be the only one" until his waiver arrived.
&lt;/p&gt;
&lt;p&gt;
We applied again anyways, and every time he came back, he looked worse.  They kept granting it, he went for treatments, and he kept looking worse. 
&lt;/p&gt;
&lt;p&gt;
Buffalo Port of Entry kept saying "we won't do this again" but they gave him 4 Port Paroles in a row, and on the fourth one, his waiver arrived. 
&lt;/p&gt;
&lt;p&gt;
3 months later, he walked into our office, the cancer in remission.   To this day I have NEVER felt better about the process, Homeland Security, and this job. 
&lt;/p&gt;
&lt;p&gt;
The Buffalo director SAVED this guys life. 
&lt;/p&gt;
&lt;p&gt;
But that was a different world, and a different administration, and a time when the US and Canada were true allies.   Buffalo did the RIGHT thing.   They saved a man's life.   I am not sure if they will do the same thing. 
&lt;/p&gt;
&lt;p&gt;
This Homeland Security office, a woman, according to the client, seemed to REVEL in the fact that she had the power to hurt this guy.   He said nothing, he left.     
&lt;/p&gt;
&lt;p&gt;
I don't think his chances are good (which he knows) because of the current posture of Homeland Security, but I am going to try VERY hard to make it hard for them to say no.   I'll keep everyone updated, and lets hope I am wrong, and they do the right thing.

&lt;p&gt;
Politics matter people.  We have an unarmed border with "our closest ally" and yet because of one corrupt person, and his racist policies, people have died.  People will continue to die.  I hope this guy isn't one of them.

Prior to that, I had only heard about EB5 which is the 1 million investment to get a green card. I've come across E2 treads on Reddit in the past, and they all seem surprisingly easy to obtain with 100k CAD and a plan to open up a business in the US.
