Guy with a September Letter here...(which I thought was supposed to allay the concerns of a typical waiver).

I've travelled to the US about 6 times this year. I've been put in Secondary EVERY SINGLE TIME. Two and a half hours at LAX was the longest. Every other time it's been 45 minutes to an hour plus (even when I was the only person in Secondary that entire time )... YYC and Pearson.

They've been very aggressive with their questioning and twice have limited my stay which seems draconian seeing as when I entered the US on May 12th, 2026 that admitting officer (actually he straight up asked me why I was in Secondary as he seemed perplexed why I was there)... he gave me until to November 14th, 2026 but every other officer has not adhered to that. One officer even limited my stay to July 13th knowing full well I was supposed to be in Dallas for the semi-final World Cup game on July 14th. I have NEVER been rude, impolite or argumentative with the officers because I'm very well aware it's a completely asymmetrical relationship and being anything but polite and calm is surely counter-productive.

Two officers told me I'd be put in Secondary every single time. I'm a born and raised Canadian citizen. Filed a redress application and still get Secondary. I have no criminal record nor have I ever been arrested. My only offense was an overstay from over 12 years ago.

Really this is frustrating and annoying. I'm at a loss and it seems the officers will just fabricate things about me. Really just mean-spiritedness, cruelty and bullying.

I dont have to "come clean" as there is no dirt on me. The only dirt that I have is you throwing it on me. Your "strong opinions" are just that- dirt disguised as opinion. Even if I shared my timeline you can still claim they are fabricated, just because it is contrary to your own lackluster knowledge.

You seem to pass judgements like a person sitting on some kind of a throne. However, your knowledge, current affairs awareness, and intelligence are all sub par, Given that you are a lawyer, at least your communication skills and comprehension skills should have been better. May i ask which college gave you a law degree?

I posted a TOPIC on this. Instead of READING it, look at his question. "Are you telling me....." isn't a question. Its a demand.

I answered with much more detail and attention than the person asking the question. And "when I went last time I was told..." without WHEN that was, or more context is LAZY.

"I went to the border on __________ and I was told __________" helps everyone and I will answer that.

I answered in the "tone" it was asked. I am not rude, but READ a bit PLEASE.

Ask anything, but ask so OTHERS can actually BENEFIT from your question and answer.

I cannot be 100% sure. I assume when you "overstay" or "work illegally" and then do a waiver, and then they say "you do not need advance permission" then you SHOULD be cleared to apply for a Nexus or Fast card.

Unlike a lot of people/organizations that do waivers, I get a LOT of "immigration issues" probably at least 30% or higher. So many of the September Letters I get are like this. The problem is I lose touch with most of the clients in this category because
-They do not need a pardon either
-They do not need another waiver,

So unlike most clients, they have no need to stay in touch. So if they DO apply for a Fast Card or Nexus Card, I would not know.

I am trying to find accurate information for clients I have. I have helped a few with these applications and want to know if more people are doing them? they are when your Green Card application is filed and you are inadmissible,

I had a waiver client who got her card proving her status from the Government of Canada.

Today, she went to the border to ask if she need a new waiver, or if she could cross.

They told her she must fill out a "Quantum Form" so I did some research.

Under U.S. law (8 U.S.C. § 1359) and the Jay Treaty, Canadian-born Indigenous people with at least 50% blood quantum have the right to freely enter, live, work, and study in the United States without a visa. To claim this status with U.S. Customs and Border Protection (CBP) or Homeland Security, individuals must prove their blood percentage.

Required Documentation

U.S. authorities do not rely on a standard Canadian status card alone to grant permanent work or residency rights under the Jay Treaty.

Acceptable proof typically includes:Blood Quantum Letter:

An official statement or ancestry letter on band/tribal letterhead, or from Crown-Indigenous Relations and Northern Affairs Canada (CIRNAC), explicitly stating a blood quantum of 50% or higher based on official genealogical records.

Long-Form Birth Certificate: Showing lineage connecting to parents/grandparents with verified status.

Secure Certificate of Indian Status (SCIS) or photo ID.

WHTI-Compliant Travel Document: Such as a valid passport if arriving by air.

Basically in Canada, your blood % does not matter. In the US it has to be seen as 50% or greater.

If anyone has any experiences with this, please chime in. Also please note I have cut and pasted much of this, so I am not vouching for its accuracy, and I certainly did not mean to offend anyone if I used any terms to identify anyone.

Recently travelled from YYZ Toronto to LGA La Guardia in July 2026

I have a waiver and my spouse has a Nexus Card.

Spouse did not use Nexus Card and used passport to enter with me.

Came to secondary with me which was optional, could have just entered but waited with me
Did not need to surrender passport while i was in secondary screening

I went and did my thing and was told all good to go. Gave me back my waiver and passport and a small piece of paper. Which I required to leave secondary

That was it

Went into secondary screening and out in a relatively fast timeline. Make sure when you hand them your passport to tell them you have a waiver. They are big on the document not being in the passport.

You do not appear to pay the 6 dollar fee any longer. At least for air travel.

Looked online and found the I94 is good until January 2027.

Still had time before traveling to USA to enter the Maple Leaf Lounge

Just to give you more context, this question is an important one and I will explain why.

Before THIS Trump term, you HAD to put on your waiver application "in the future I may also want to apply for a TN/O/E Visa if you planned to apply for one once your waiver was granted.

We know this because I had MANY clients who had 5 year waivers, and when they would try and apply for these visas, they had to get a brand new waiver with this designation.

I have a friend who works for Homeland Security (he now works in Hawaii but used to work at Pearson and trained with me in MMA) and he explained it this way. When they are considering your waiver application, the fact you MIGHT want to apply for a VISA is important in their consideration. Many clients I have are doing waivers not because of criminal records, but for things such as "applying for asylum-application rejected" "misrepresentation" and "overstaying" as well as "working illegally". If you apply for a waiver and do not tell them your intentions, they may have given you a waiver for a shorter period for example.

Now, they have changed this again. Instead of simply ignoring the "I may wish to apply for____ in the future" or adding it to the waiver, they STOP the application, and ASK, "do you want the waiver? Or should he close the file so you can apply for the Visa?"

This makes no sense, since if you are INADMISSIBLE, you cannot get a visa, you cannot even VISIT. The waiver "waives" your inadmissibility.

Anyways, this is the REAL reason this has come up. My advice? Since they are making it difficult to get these Visas anyways, and since 80% of 1st waivers are 1 year anyways, just apply for the waiver, and then hopefully if you get an opportunity to apply for a TN visa or any other visa, just apply separately.
