Testimony by Analysis Group Affiliate Glenn Hubbard Supports Exclusion of Opposing Expert’s Damages Model in Event-Driven Securities Litigation Involving Mining Company

Analysis Group was retained by Gibson Dunn on behalf of Vale S.A., one of the largest mining companies in the world, the defendant in a long-running Rule 10b-5 securities fraud class action. The class plaintiffs, purchasers of Vale stock and bonds, alleged that the company and certain executives made a series of misstatements about the company’s risk-management practices and the safety of its operations. When a dam at one of Vale’s mines subsequently collapsed, the prices of the company’s securities fell. The plaintiffs sought damages related to the decline in the value of Vale’s securities after the incident.

An Analysis Group team led by Managing Principal Mark Egland, Principal Kevin Gold, Vice President Ahmer Nabi, and Managers Anastasia Bogdanova and Thomas Zimmerfaust supported academic affiliate Glenn Hubbard, who filed an expert report and testified at deposition and at a Daubert motion hearing. In his rebuttal to plaintiffs’ expert’s damages analysis, Professor Hubbard explained that an appropriate damages analysis should isolate the impact of the alleged fraud, including assessing the difference between investors’ assessment of the probability of an adverse event occurring given the alleged misrepresentations, and the ‘true’ probability of the event occurring. In particular, Professor Hubbard critiqued the plaintiffs’ expert’s contention that 100% of the drops in the securities’ prices after the dam collapse were due to the allegedly fraudulent statements, rendering the expert’s damages model unreliable from an economic perspective.

The US District Court for the Eastern District of New York excluded the plaintiffs’ expert’s damages calculation. In its opinion, the court agreed with the defendants’ “principal criticism of Dr. Feinstein’s damages model” and found the plaintiffs’ expert’s damages model unreliable. Specifically, the court agreed with Professor Hubbard regarding the appropriate damages framework involving the materialization of an understated risk, noting that “the appropriate measure of inflation is the difference between the perceived and actual risk of a dam collapse,” and, relatedly, that the plaintiffs’ expert’s model “fails to disaggregate the investment losses caused by Vale’s alleged misrepresentations – i.e., the ostensible understatement of the risk – from the losses caused by the actual dam collapse.”

Analysis Group Managing Principal Lisa Pinheiro is serving on the Independent Market Integrity Committee engaged by the prediction market Kalshi to help strengthen its market integrity safeguards. The committee, which was formed as part of an expansion of Kalshi’s surveillance and enforcement framework, is tasked with providing independent scrutiny of Kalshi activity in order to guard against market manipulation, insider trading, and attempted fraud.

According to an article in The Wall Street Journal, the committee has recommended tighter security measures to address the risk that users may trade in certain event markets based on material nonpublic information. Kalshi plans to require users participating in some sensitive markets, including those related to company performance and national security, to disclose their employers, with the goal of improving surveillance, supporting investigations of suspicious activity, and deterring potential misuse.

The Independent Market Integrity Committee brings together expertise in financial crime enforcement, forensic analytics, and financial economics. Its members include Brian Nelson, former US Treasury Under Secretary for Terrorism and Financial Intelligence and a partner at Cooley LLP; Daniel Taylor, director of the Wharton Forensic Analytics Lab and a professor at The Wharton School of the University of Pennsylvania; and Ms. Pinheiro, an expert in quantitative financial economics and market manipulation analytics.

Analysis Group affiliate Catherine Tucker shared how AI is altering the competition landscape at private dinner events in New York City and Washington, DC, hosted by the firm. Professor Tucker is an industrial organization economist and the Sloan Distinguished Professor of Management at the MIT Sloan School of Management. She heads the NBER Initiative on Digital Economics and AI. The dinner programs were organized by Managing Principals Kris Comeaux, Rebecca Kirk Fair, Andrea Okie, and Aaron Yeater.

In her remarks, Professor Tucker described the layers of the AI stack and the competitive dynamics in each. She emphasized that we should not be distracted by the current profitability of different layers of the AI stack, and that economists should still consider whether barriers to entry exist in the form of network effects, switching costs, or unique data inputs for any layer in the stack. She described her current work detailing the lack of network effects in the applications layer and industry innovations that are reducing switching costs.

Professor Tucker analogized the current competitive environment in the AI stack to prior waves of technological innovation, including internet service providers, search, and e-commerce. She also engaged in a question-and-answer session with the audience.

Vice President Cyril Hariton Assists Cycling Equipment Manufacturer SRAM in Antitrust Dispute Against International Cycling Union

Analysis Group Vice President Cyril Hariton was retained by Norton Rose Fulbright on behalf of SRAM, a manufacturer of cycling transmission systems, in a competition complaint filed against Union Cycliste Internationale (UCI) in connection with UCI’s maximum gearing technical standard. The matter concerned UCI’s Maximum Gear Ratio Test Protocol, which would have limited the maximum gear ratio allowed in certain professional road cycling events. SRAM challenged the protocol before the Belgian Competition Authority (BCA), arguing that the rulemaking process was not transparent, objective, or non-discriminatory, and that the protocol would disproportionately affect SRAM and professional teams using SRAM drivetrain systems.

Dr. Hariton supported SRAM before the BCA, assessing the competition economics issues at and available safety-related statistical data. He also demonstrated that there was no convincing quantitative evidence capable of supporting UCI’s standard.

The BCA imposed interim measures suspending implementation of the protocol. Subsequently, the Brussels Court of Appeal (Markets Court) dismissed UCI’s appeal in full and affirmed the BCA’s decision. The Markets Court confirmed that the BCA had validly concluded, on a prima facie basis, that the protocol raised competition concerns due to shortcomings in transparency, objectivity, and non-discrimination. The court also found that UCI had not justified why the protocol was necessary and proportionate to advance rider safety, and that the BCA had properly assessed the risk of serious, immediate, and difficult-to-repair harm to SRAM and teams using SRAM transmission systems.

Dr. Befurt has served as an expert witness in matters involving patent infringement, trademark disputes, false advertising, product liability, and consumer disclosures, and has testified at deposition and trial. Carletta Wong has experience applying expertise in economics and financial analysis to support experts in a variety of litigation and international arbitration matters, including those involving corporate transactions and governance, finance, accounting, antitrust, pharmaceutical reverse payments, commercially reasonable efforts, intellectual property and trade secrets, and government investigations of pharmaceutical clients. Her case work has spanned a broad range of industries, including health care, entertainment and media, telecommunications, finance, software and technology, real estate, and manufacturing. In several complex commercial disputes in the Delaware Chancery Court, Ms. Wong has led the support for teams of experts addressing valuation and damages, solvency, corporate governance, platform economics, and media and technology issues. Dr. Navathe is a health economist and a staff physician at Penn Presbyterian Medical Center. He specializes in the design and evaluation of health care payment and reimbursement models, health plan coverage, and medical service and prescription drug pricing, among other topics. Dr. Navathe’s research has been published in numerous peer-reviewed journals on topics such as machine learning and health care decision-making, improving the accuracy of risk adjustments, understanding the impact of value-based care and other payment models, and designing physician incentives to deliver high-value care.

Analysis Group Authors Contribute to Policy Paper on Improving Early-Stage Cancer Care

A central policy challenge in early-stage cancer care is how to evaluate and provide timely access to therapies while evidence is still evolving. Early detection and treatment can improve the likelihood of successful treatment and survival, underscoring the need for timely evidence on therapies in early-stage settings. In this context, early clinical endpoints – including event-free survival, disease-free survival, invasive disease-free survival, and recurrence-free survival – can provide earlier evidence on treatment effectiveness, which can then inform regulatory, reimbursement, and clinical decisions.

In the Journal of Medical Economics, Analysis Group Vice Presidents Debbie Goldschmidt and Jenny Zhou, together with academic affiliate Lou Garrison, of the Comparative Health Outcomes, Policy, and Economics (CHOICE) Institute at the University of Washington School of Pharmacy, contributed to a policy paper that examines challenges in early-stage cancer diagnosis, treatment, and access. While early diagnosis and treatment can significantly improve patient outcomes, rates of early-stage detection continue to vary across tumor types and patient populations. The paper emphasizes that assessing treatment value in early-stage cancer can require considering a range of evidence, including early clinical endpoints that capture meaningful outcomes for patients such as whether treatment helps them remain disease-, event-, or recurrence-free.

Drawing on clinical and economic evidence, the authors explain that evidence-generation and value-assessment challenges in early-stage cancer care should not become a barrier to timely access. Instead, they highlight the importance of incorporating early clinical endpoints alongside other clinical, economic, and access considerations into evidence generation, value assessment, and reimbursement discussions, particularly when those measures reflect outcomes that matter to patients and can offer timely insights into whether innovative therapies reduce recurrence risk.

A key recommendation from the authors is the integration of early cancer care more fully into national cancer control plans, supported by stronger data collection and monitoring, improved health literacy, and more coordinated approaches to reimbursement and value assessment. Overall, they conclude that improving early-stage cancer care will require better alignment across stakeholders to enhance diagnosis rates, reduce the burden of recurrence, and expand timely access to effective treatments as evidence continues to evolve.

Analysis Group Affiliate Ashish Jha Supports Defense Verdict in COVID-19 Vaccine Securities Class Action

Analysis Group was retained on behalf of Armistice Capital, Armistice Capital Master Fund, and two Armistice executives, the defendants in a Rule 10b-5 securities fraud class action involving Vaxart, a clinical-stage biotech company developing oral recombinant vaccines. The plaintiffs alleged that Armistice orchestrated a stock manipulation and insider-trading scheme by causing Vaxart to issue false and misleading press releases regarding its COVID-19 vaccine candidate, including statements about Operation Warp Speed (OWS) and manufacturing capabilities. The plaintiffs claimed these statements artificially inflated Vaxart’s stock price, allowing Armistice to sell millions of shares at elevated prices before a subsequent decline.

An Analysis Group team led by Managing Principal Gaurav Jetley and Vice Presidents Michaela Johnson and Erica VanSant supported affiliate Ashish K. Jha, former White House COVID-19 Response Coordinator, who submitted an expert report and testified at trial. At trial, Dr. Jha testified on the known scope and criteria for OWS participation at the time of Vaxart’s statements. Price discrimination claims under the Robinson-Patman Act (RPA) have seen a resurgence in recent years, particularly in cases alleging that suppliers charged different prices for the same goods to competing downstream resellers, known as secondary-line claims. In parallel, firms are increasingly varying the promotion and pricing of their products across brick-and-mortar, e-commerce, and wholesale channels to accommodate the preferences and purchasing behavior of end customers. In some cases, resellers operating in different channels may not actually compete for the same customers, raising questions about when price discrimination results in injury to competition under the RPA.

Analysis Group Researchers Find Bariatric Surgery Rates Declining as GLP-1 Use Rises

As the use of GLP-1 medications continues to rise in the US, their effect on rates of metabolic bariatric surgery (MBS) as a treatment for obesity and related cardiometabolic conditions remains an important question for patients, providers, and policymakers. Although prior research suggests that MBS utilization may be declining, examinations of national trends during the GLP-1 era have been limited to a period prior to the US Food and Drug Administration (FDA) approval of tirzepatide.

To quantify the association between GLP-1 use and rates of MBS, researchers, including Analysis Group Managing Principal Stephen Fink, Manager Robert J. Calzaretta, and affiliate Professor Thomas Tsai analyzed IQVIA PharMetrics® Plus with Mortality claims data from more than 11.7 million insured patients. In a research letter published in JAMA Surgery, the authors compare the quarterly rates of GLP-1 prescriptions and MBS utilization among patients with at least one obesity, overweight, or diabetes diagnosis from 2022 through 2024.

The authors find that GLP-1 use increased by more than 140% over the study period, while MBS utilization declined by 34%. Despite the rapid growth in GLP-1 medication use, they report that only about 9.5% of eligible patients received either a GLP-1 prescription or MBS, suggesting that obesity remains substantially undertreated. Their findings underscore the importance of monitoring evolving treatment patterns and ensuring patient access to both pharmacologic and surgical options for obesity care.

UK High Court Adopts FRAND Analysis of Analysis Group Academic Affiliate Justus Baron in Samsung v. ZTE

Testimony from Analysis Group affiliate Justus Baron contributed to a trial win for Samsung Electronics in patent litigation brought against ZTE Corporation and related entities in the UK High Court of Justice. The case centered on a dispute over the terms of a global cross-license for the use of both parties’ standard essential patents (SEPs) for 4G and 5G mobile-phone technology following the expiration of a prior patent license agreement (PLA). While Samsung claimed that ZTE’s prior PLAs with Samsung and Apple should form the basis of the FRAND price, ZTE argued that Samsung’s license agreements with patent owners Ericsson, Nokia, and InterDigital (ENI), were a more appropriate benchmark.

Dr. Baron was retained on behalf of Samsung to evaluate the validity of a quantitative patent count comparison of the ZTE and ENI patent portfolios. He found that the ZTE portfolio, with many China-only and single-office patents, was not sufficiently comparable to the more established and geographically broad portfolios held by ENI.

Noting that “Dr Baron’s views were well-reasoned and carefully and precisely presented,” Mr. Justice Meade accepted Dr. Baron’s conclusion that “ZTE’s portfolio…cannot be reliably compared to portfolios of other SEP licensors such as Ericsson, Nokia, and InterDigital” and that “patents that belong to geographically broad patent families…are substantially more valuable.” Consistent with Samsung’s argument, the judge determined that ZTE’s prior PLAs should form the starting point for the new license terms.

Analysis Group Collaborates in Prospective Multicenter Study on the Role of Screening Strategies for Advancing Early Detection of Pulmonary Hypertension in Patients with Interstitial Lung Disease

Pulmonary hypertension (PH) is a common complication of interstitial lung disease (ILD) that is associated with diminished quality of life and decreased survival. The US Food and Drug Administration (FDA) has approved a therapy to improve exercise capacity among patients with ILD-associated PH. However, standardized screening for PH in patients with ILD is lacking, which can lead to delays in diagnosis and treatment.

To identify appropriate parameters for the detection of PH in those patients, researchers including Managing Principal Maral DerSarkissian collaborated on the Pulmonary Hypertension Screening in Patients with Interstitial Lung Disease for Earlier Detection (PHINDER) study. PHINDER is a multicenter, non-interventional prospective study of clinical, functional, imaging, and echocardiographic information collected from pre-specified assessments that were incorporated into clinical workflows within participating health care centers. The research required complex coordination across multiple centers and health care providers to support patient recruitment and enrollment, integration of assessments into routine care, and prospective data collection from approximately 200 patients, with a target enrollment of up to 300 patients. The study identified potential predictors of PH using data from patients with ILD who underwent the pre-specified assessments and right heart catheterization.

In an article describing their work, the researchers present preliminary evidence that combining pulmonary function testing, lung imaging, and echocardiography could improve earlier and more accurate detection of PH among patients with ILD. They conclude that their preliminary findings support the integration of imaging tests and functional assessments in PH diagnostic screening protocols for patients with ILD. Final analyses are underway.

The article, “Screening for Pulmonary Hypertension in Interstitial Lung Disease: Preliminary Results from the PHINDER Study,” was published in Advances in Therapy. Funding for the study was provided by United Therapeutics.

Analysis Group Managing Principal Joshua White, Principal Chris Feige, and Vice President Cyril Hariton hosted the first in Analysis Group’s Experts’ Table discussion series in Brussels, convening a small group of legal practitioners to discuss AI at the intersection of economics, law, regulation, and policy. The conversation featured academic affiliate Timothy DeStefano, an applied economist whose work focuses on digital technology, AI, industrial robotics, firm productivity, and trade.

The discussion explored whether AI markets are naturally prone to concentration, given the importance of costly inputs such as cloud infrastructure, computing resources, advanced models, and proprietary data. Participants considered whether scale advantages and first-mover positions may favor a small number of firms, or whether factors such as hardware innovation, specialized models, open-source tools, and tailored use cases could help keep the market competitive.

The group also discussed the challenges of AI diffusion across firms and the implications for Europe’s competitiveness. Participants noted that adoption is not simply a question of access to frontier technology: Firms also face organizational, skill, infrastructure, and investment barriers. The group considered whether Europe should broaden its focus beyond innovation and digital sovereignty to diffusion-enabling conditions such as cloud adoption, data interoperability, and digital infrastructure.

Citing Analysis Group Experts, Court Grants Summary Judgement to M&T Bank in Merger Class Action

Analysis Group was retained on behalf of M&T Bank Corporation and related entities, defendants in a shareholder class action. The plaintiffs alleged that disclosures in a proxy statement to shareholders omitted material information regarding regulatory issues that significantly delayed the bank’s $3.7 billion merger with Hudson City Bancorp.

An Analysis Group team led by Managing Principals Mark Howrey and Gaurav Jetley, Principal Xinyu Ji, and Vice Presidents Emma Dong, Alex Fiore, Ilona Mostipan, and Mike Nguyen supported three affiliated experts in the matter:

Professor David J. Denis evaluated the plaintiffs’ damages theories and methodologies, including whether the alleged disclosure deficiencies could be linked to any economic loss.
Professor Wei Jiang analyzed the presence of merger arbitrageurs in the proposed class and resulting implications for class-wide damages.
Charles H. Grice, a regulatory and risk management expert, offered an opinion about bank examinations and the bank merger review process.

At the class certification stage, the US District Court for the District of Delaware considered concerns about heterogeneity among shareholders, including issues related to merger arbitrageurs raised by Professor Jiang, as well as whether plaintiffs could establish loss causation and damages through common evidence. The judge denied class certification, citing critiques advanced by Professor Denis in concluding that the plaintiffs’ event study did not provide a sufficient basis to measure or attribute alleged losses across the class.

The court ultimately granted summary judgment for defendants on all remaining claims, finding that the plaintiffs’ damages theories were “wholly speculative.” The court rejected the plaintiffs’ event study for failing to account for confounding factors and for relying on unsupported event dates, reasoning consistent with Professor Denis’s report. The court also concluded that M&T Bank was barred from certain disclosures due to bank examination privilege, citing to analysis by Mr. Grice, for which “Plaintiffs offered no rebuttal expert testimony.”

Analysis Group Authors Examine How AI Can Enhance Securities Litigation Analysis

Securities class action litigation depends on complex assessments, including the evaluation of comparable cases and the prediction of settlement outcomes. Historically, these analyses have relied on structured data and limited manual review of complaint text, constraining the range of observable case characteristics and the insights that can be drawn from unstructured legal filings.

In an article published in Law360, Analysis Group Managing Principal Mark Howrey and Vice President Emma Xiaoxiao Dong examine how AI-assisted review of complaint text can enhance securities litigation analysis. Focusing on two key areas – identifying comparable cases and predicting settlement outcomes – the authors show how AI can expand the scope and depth of these analyses.

Drawing on a database of more than 700 federal securities class action settlements, the authors demonstrate how AI can systematically extract case characteristics – such as the nature of allegations and corrective disclosures – that enable more robust identification of comparable cases. They find that differences in the type and substance of corrective disclosures are associated with variation in settlement outcomes – for example, disclosures tied to enforcement actions are generally linked to higher settlement percentages than those involving investigations alone.

The authors also find that sentiment-based measures of complaint language provide additional explanatory power in modeling settlement amounts, reducing prediction errors beyond models based solely on damages. At the same time, they emphasize that the complexity of securities litigation cannot be fully captured through AI-assisted analysis alone, as certain key drivers of settlement outcomes – such as defendants’ insurance structures – are not observable in public data. Accordingly, AI-based insights are best viewed as a complement to, rather than a substitute for, legal and economic judgment.

The Roundtable will examine how economic models of bargaining are applied in antitrust enforcement, with implications for merger review, conduct investigations, and labor market cases.

Analysis Group Supports Corsair in European Commission Review of State Aid

Analysis Group was retained on behalf of French airline Corsair in connection with the European Commission’s (EC’s) review of state aid granted to the airline by the French government. The review assessed whether the aid was compliant with EC guidelines for governmental aid to restructure companies in financial distress.

A team led by Managing Principal Antoine Chapsal and Managers Zsolt Udvari and Krisztina Horvath worked alongside Emmanuel Combe, former vice president of the French Competition Authority and an airline industry specialist, to assess the economic impact of the state aid. The Analysis Group team submitted several reports to the EC’s Directorate-General for Competition (DG COMP) over the course of the proceedings.

The team’s economic analysis included:

An econometric study of airline fares under a counterfactual scenario in which Corsair ceased its activity
A simulation analysis of the economic impact of this counterfactual scenario on particular regions where Corsair operates
An analysis of entry barriers and incentives on certain central airline routes

Chan School of Public Health) will present an educational symposium titled “Driving the Next Era of Evidence-Based Medicine through AI, Diverse Data, and Collaboration.” The symposium will explore how cutting-edge GenAI methodology can be applied to develop comprehensive and up-to-date insights on diseases and treatment outcomes from heterogeneous data sources. Presenters will showcase the application of GenAI with digital twin methodologies to simulate the long-term progression of obesity and chronic cardiometabolic diseases.

The symposium will also introduce a new real-world evidence research initiative jointly launched by the Harvard T.H. Chan School of Public Health and Analysis Group, focused on advancing precision health through the application of AI to better understand disease pathways, treatment effectiveness, and personalized health. The symposium will be held on Tuesday, May 19, at 12:15 p.m.

Principal Paul Hibbard Outlines Changes Needed for Rate Redesign Amid Massachusetts Energy Transition

In October 2025, Massachusetts Governor Maura Healey directed the state’s Department of Public Utilities (DPU) to conduct a comprehensive review of gas and electric rates, as part of a statewide effort to stabilize and reduce utility bills. Included in her request was an assessment of “each and every charge that customers are currently paying to determine whether the charge can be eliminated, reduced, or its impact mitigated.” Analysis Group Principal Paul Hibbard prepared a rate design and energy affordability report that was attached to a filing from natural gas and electric company National Grid, as part of the DPU’s ongoing investigation.

In the report, Mr. Hibbard – a former DPU chair – explained that while the existing rate structures have served Massachusetts well for decades, fundamental changes are required to support electricity demand growth, manage growing grid investment needs, and protect long-term energy affordability. According to the report, the transition in rate design is necessary to achieve the Commonwealth’s energy policy goals while also satisfying traditional regulatory goals of economic efficiency, equity, and fairness.

Among the suggested changes to the rate structures is a greater mix of fixed charges, demand-based pricing, and targeted time-varying rates, as well as increased demand response, flexible interconnection of distributed energy resources, and affordability protections for low- and moderate-income customers. The report recommended that the Commonwealth work with utilities and stakeholders to establish a clear path through 2040, so that rate design evolves in step with Massachusetts’s broader energy transition.

Analysis Group Researchers Leveraged Mass General Brigham Data to Investigate When Hospitalized Patients with Complicated UTIs are Clinically Ready for Discharge

Patients with complicated urinary tract infections (cUTIs) caused by highly resistant organisms often require intravenous (IV) antibiotics such as carbapenems, which are most frequently administered at the hospital. In many cases, patients must remain hospitalized until they complete the full course of treatment, even when they are otherwise deemed clinically ready for discharge (CRFD). These extended stays can increase health care costs, raise the risk of hospital-acquired infections, and affect patients’ quality of life.

An Analysis Group team – led by Managing Principal Mei Sheng Duh, Vice President Rose Chang, and Manager Louise Yu – collaborated with researchers from GlaxoSmithKline and Mass General Brigham (MGB), including Dr. Shawn Murphy, Dr. Serena Koenig, Dr. Grace Hsieh, and members of the HIRO Data Science and Analytics team, on a real-world study that developed and applied a clinically relevant, rule-based definition of CFRD in patients with cUTIs.

The researchers leveraged electronic health record data from the MGB Research Patient Data Registry, which contains detailed clinical information and provider notes from eight Harvard-affiliated hospitals. CRFD was defined using indicators such as temperature, lab results, pain, urinary symptoms, and overall clinical stability to identify when a patient is well enough to leave the hospital.

Applying this definition, the team found that between 35 to 60% of patients hospitalized for cUTIs and treated with IV carbapenems remained hospitalized longer than was clinically necessary, for an average of three days, likely to complete the course of IV antibiotic treatment. The researchers conclude that their findings highlight the unmet need for new, safe, and effective oral antibiotic treatments that may enable outpatient management, shorten hospital stays, and improve patient experiences for patients with cUTIs caused by highly resistant organisms.

The study, funded by GlaxoSmithKline, was presented at the International Conference on Pharmacoepidemiology and at IDWeek 2025.

Settlement Ends Bored Ape Yacht Club NFT Trademark Case Following Court Decision Supported by Analysis Group Expert Testimony

The trademark dispute between Yuga Labs and artist Ryder Ripps and his business partner Jeremy Cahen has ended, with the parties filing a notice of settlement in April 2026 following an appeal in the Ninth Circuit. The settlement imposed a permanent injunction and required Ripps and Cahen to transfer the disputed project’s smart contracts, domain names, and remaining non-fungible tokens (NFTs) to Yuga Labs.

The resolution follows a prior ruling by the US District Court for the Central District of California in favor of Yuga Labs, which found that Ripps and Cahen infringed Yuga Labs’ trademarks by creating and selling rival NFTs that reused images and branding from the Bored Ape Yacht Club (BAYC) collection. The court determined that the defendants had deliberately created market confusion, permanently enjoined them from marketing or selling the infringing NFTs, and ordered the transfer of associated digital assets. It also awarded Yuga Labs nearly $1.6 million in damages, along with costs and attorneys’ fees.

Analysis Group supported Yuga Labs in the litigation. The team, led by Managing Principal Kris Comeaux and Vice Presidents Tracy Offner, Marcello Santana, and Mary Reiser, worked with two experts – Managing Principal Lauren Kindler and Principal Laura O’Laughlin – who testified at trial. Ms. O’Laughlin conducted two consumer surveys to assess the likelihood of confusion, and Ms. Kindler assessed Yuga Labs’ damages. The court described Ms. O’Laughlin’s testimony as “relevant, reliable, and admissible” and awarded the exact damages amount calculated by Ms. Kindler.

Yuga Labs, Inc. v. Ryder Ripps, et al. was named an Impact Case of the Year at the 2026 Managing IP Americas Awards, highlighting its role in shaping how traditional trademark principles apply to blockchain-based digital assets.

Analysis Group Managing Principal Lisa Pinheiro and Vice President Mark Berberian moderated panels at the inaugural Digital Assets and Emerging Technology Policy Summit, an invite-only gathering of regulators, members of congress, academics, and industry leaders to share perspectives on US digital asset and emerging technology regulation. The summit was developed and led by Vanderbilt University Law School Associate Dean and Analysis Group affiliate Yesha Yadav and cohosted by Vanderbilt University and the Blockchain Association.

During a fireside chat, Professor Yadav spoke with Commodity Futures Trading Commission (CFTC) Chairman Michael Selig about his efforts to align regulatory policy and promote cooperation between the CFTC and the US Securities and Exchange Commission (SEC). They also discussed the CFTC’s policy priorities and regulatory agenda, including potential frameworks for CFTC-regulated perpetuals in the US, efforts to assert and clarify the agency’s jurisdiction over prediction markets, and other initiatives aimed at maintaining a regulatory framework that allows for creativity and innovation.

Following Professor Yadav’s panel, Ms. Pinheiro moderated a conversation about the regulation of emerging frontier markets with panelists Coy Garrison (Robinhood), Chris Giancarlo (Willkie), Lee Schneider (Avalanche Labs), Justin Slaughter (Paradigm), and Matthew Solomon (Cleary Gottlieb). The panelists discussed the policy challenges of regulating new digital asset markets in the US, including the impact of operating across overlapping domestic and international regulatory regimes and uncertainty around incorporating compliance into permissionless blockchain infrastructures. The conversation also explored legal uncertainty surrounding prediction markets, including conflicting federal and state authority as well as the application of existing insider trading frameworks to a wide range of event-based contracts. Regarding how the CFTC may approach such challenges, panelists noted the CFTC’s stated commitment to rulemaking, including regulatory frameworks for perpetuals and other frontier markets, and its efforts to aggressively protect its jurisdiction over marketplace regulation.

In the afternoon, Mr. Berberian moderated a panel on tokenization and the future of capital markets infrastructure with panelists Salman Banaei (Plume), Chris Brummer (Georgetown Law and Fintech Foundation), Linda Jeng (Aave Labs), Vy Le (Veda Labs), Amy Oldenburg (Morgan Stanley), and Sara Weed (Gibson Dunn). The conversation centered on compliance, regulation, and ownership, and how blockchain technology may reconfigure these elements of the trading landscape. Panelists discussed tokenization as a way to enable the automation and embedding of rule-based systems and compliance measures within a protocol, such as screening for sanctioned wallets at the outset of a transaction, which may encourage more blockchain usage – including from regulated institutions – and thus greater liquidity. Panelists also shared insights on maximal extractable value (MEV).

Swedish Supreme Court Decision Favors Ukraine, Ends Long-Running Dispute

Analysis Group Principal Jessica Resch and Senior Advisor Tim Giles were retained as quantum experts on behalf of Ukraine in a Stockholm Chamber of Commerce (SCC) arbitration brought by three Cypriot companies – Littop Enterprises, Bridgemont Ventures, and Bordo Management – related to alleged losses associated with minority shareholdings in Ukrnafta, Ukraine’s largest oil and gas producer. The claimants alleged that Ukraine breached Energy Charter Treaty (ECT) rules by capping the price at which Ukrnafta could sell gas to Ukraine’s state-owned oil company Naftogaz at a level lower than Ukrnafta’s cost of production.

Ms. Resch and Mr. Giles submitted expert reports and gave evidence during the hearing before the tribunal, which included Julian Lew, Yves Fortier, and Rodrigo Oreamuno. Their evidence focused on the quantum of damages associated with the claimed losses and addressed the impact of claimants’ alleged fraudulent activities.

The SCC tribunal declined jurisdiction over the companies’ claim on the grounds that the claimants’ investment in Ukrnafta was not protected under ECT rules. The claimants sought to annul the tribunal’s award in the Swedish courts, later requesting to appeal the lower court’s decision not to overturn the tribunal’s judgment. The Svea Court of Appeal upheld the tribunal’s decision to decline jurisdiction and ordered the claimants to pay part of Ukraine’s arbitration costs. The Swedish Supreme Court declined to hear a further appeal, bringing the long-running dispute to an end.

Analysis Group Authors Examine the Role of the Blocking Patent Defense in Pharmaceutical Litigation

In pharmaceutical litigation, the blocking patent defense is used increasingly to rebut a patent owner’s claim that a drug’s commercial success reflects the non-obviousness of an underlying patent. The proffered defense is often that the success of the at-issue patent is due to an earlier patent that likely deterred competitors from developing the at-issue patent before the patent owner actually did. Application of the defense in practice raises important questions about how courts should evaluate the impact of earlier patents on innovation and competition.

In the AIPLA Quarterly Journal, Analysis Group Managing Principal John Jarosz and Vice Presidents Andrea Hugill and Anna Gumen, together with Michael Chapman (Envision Economics), examine the role of the blocking patent defense and trends in its application.

The authors analyze how courts apply the defense and evaluate whether the application properly reflects real-world incentives for drug development. Drawing on economic analyses and empirical evidence, the authors explain that innovation can and often does proceed, despite the presence of an earlier “blocking” patent. They emphasize that the relevant inquiry is not simply whether a patent may have blocked innovation, but whether it actually did and to what degree it may have or did block innovation. In their view, the blocking inquiry should not be answered with a simple “yes” or “no” but instead requires evaluating the extent to which a patent influenced, or could influence, behavior in the relevant field.

The authors highlight the importance of evaluating real-world evidence on research and development, forward citations, and clinical trials. They note that, rather than relying solely on theoretical assumptions about deterrence, courts can and should consider whether innovation continued in practice. The article also presents a structured framework for incorporating real-world evidence to evaluate blocking patent claims.

The authors conclude that, while the blocking patent defense has gained traction in pharmaceutical litigation, its application is highly fact dependent. Determining whether a patent meaningfully constrained innovation requires a case-specific inquiry supported by concrete evidence, often requiring careful contextual interpretation. Particularly in cases involving pharmaceuticals, assessing the blocking patent defense can benefit from a nuanced, evidence-based approach that reflects how innovation and competition function in the industry.

Canadian Federal Court Dismisses Class Certification Bid in Generic-Related Antitrust Case Against Analysis Group Pharmaceutical Clients

Analysis Group was retained on behalf of the defendants in a Canadian antitrust case brought on behalf of purchasers of generic drugs. The plaintiffs alleged that multiple pharmaceutical companies entered into a conspiracy to fix prices and allocate the market in Canada and the US for generic drugs and sought certification of a class consisting of Canadian purchasers.

An Analysis Group team led by Managing Principal Dov Rothman and Vice President David Toniatti supported academic affiliate James Levinsohn, who filed multiple expert reports and testified at deposition. Professor Levinsohn rebutted the plaintiffs’ expert’s report, opining that the expert had not presented a reliable methodology to prove antitrust injury or estimate class-wide damages.

A judge in the Federal Court of Canada ruled in favor of the defendants, holding that the plaintiffs had not established several criteria necessary for certification of the class.

Milestone Study on Pfizer-BioNTech’s COVID-19 Vaccine Coauthored by Analysis Group Researchers Completed and Fulfilled Regulatory Requirement for Vaccine’s Approval

Active safety surveillance is an essential part of vaccine evaluation, and its role is even more critical in the context of public health emergencies such as the COVID-19 pandemic. A safety surveillance study conducted by researchers from Analysis Group, Pfizer, and the Veterans Health Administration (VHA) fulfilled a necessary regulatory requirement for the US Food and Drug Administration (FDA) and the European Medicines Agency (EMA), finding no increased safety risks associated with the vaccine.

In March 2020, the World Health Organization declared a global pandemic for COVID-19, caused by infection with severe acute respiratory syndrome coronavirus 2. Nine months later, the FDA and EMA granted emergency use authorization (EUA) for the Pfizer-BioNTech COVID-19 vaccine for individuals 16 and older. Regulatory agencies required post-EUA safety studies using Veterans Affairs (VA) electronic medical record (EMR) data to assess long-term safety risk beyond the observation period in clinical trials for over 40 safety endpoints in a diverse real-world population.

To meet this research objective, an Analysis Group team led by Managing Principal and Chief Epidemiologist Mei Sheng Duh and Managing Principal Maral DerSarkissian – with analytical and review support from CEO Pierre Cremieux; Vice President Marianne Cunnington; Managers Catherine Nguyen, Angela Lax, and Mu Cheng; and Associate Tracy Guo – partnered with researchers from Pfizer and the VHA to conduct a safety surveillance study to assess potential serious safety events associated with the vaccine that may not have been detected during clinical trials. This study was critical for the Pfizer-BioNTech vaccine because its clinical trial had had a shorter-than-usual median observation time, given the expanding COVID-19 health crisis.

For the study to be included in the EUA application, a protocol – which served as the study’s technical foundation and outlined its rationale and design, and the methods by which data would be collected and outcomes assessed – was needed on an accelerated timeline for inclusion in the submission package to regulatory agencies. Analysis Group researchers designed the study protocol in collaboration with Pfizer and the VHA to identify near-real-time safety signals among vaccinated individuals. Forty-six pre-specified safety events of interest were included in the safety surveillance program, including myocarditis/pericarditis, cerebrovascular non-hemorrhagic stroke, acute myocardial infarction, and anaphylaxis.

Once the EUA was issued, the team began analyzing data to assess whether safety signals were observed in the VHA population of Pfizer-BioNTech COVID-19 vaccinees as compared with a control group of seasonal flu vaccine recipients. Researchers analyzed data continually over three and a half years and found no increased safety risk associated with the Pfizer-BioNTech COVID-19 vaccine.

More broadly, this study generated robust scientific evidence on safety of the Pfizer-BioNTech COVID-19 vaccine to a broader population, bolstering public confidence and addressing an ongoing need for scientifically sound research in the vaccine safety area.

SEC Voluntarily Dismisses Negligence Claims Against Analysis Group Client in Accounting Litigation

Analysis Group consultants and three affiliated experts contributed to a favorable outcome for the former CFO of “smart” glass manufacturer View, Inc. in an accounting litigation brought by the US Securities and Exchange Commission (SEC). Retained on behalf of former CFO Vidul Prakash, Analysis Group experts addressed SEC allegations that View’s accounting treatment for the projected costs to replace defective window products was inappropriate, resulting in alleged GAAP violations and the omission of material information about View’s financial condition.

An Analysis Group team supported three affiliates:

Eileen Kamerick opined on whether Mr. Prakash’s actions were consistent with the customary and accepted practices of public company CFOs.
Robert Conway opined on whether View’s accounting conclusions complied with GAAP and whether the involvement of View’s external auditor in both the company’s accounting conclusions and decision to issue financial restatements was consistent with customary audit practice.
Professor David Denis opined on the economic significance of the projected costs for replacement windows to View’s financial condition and valuation and on the factors that affected View’s stock price over the course of the company’s internal investigation and restatement process.

Analysis Group Experts Support HDMI Licensing Administrator in Favorable Summary Judgment on Antitrust Claims

Analysis Group was retained on behalf of the licensing administrator for the High-Definition Multimedia Interface (HDMI) specification, the defendant in an antitrust litigation brought by software and electronics company Availink. Availink alleged that HDMI Licensing Administrator (HDMI LA) and its founders violated antitrust and unfair competition laws because they possessed market power in markets that use the HDMI specification, and restrained competition in those markets through specific terms in their adopter agreement.

An Analysis Group team led by Vice Presidents John Browning, Owen Hearey, and Yuan Tian, supported two experts: affiliate Justus Baron and Vice President Kristof Zetenyi, both of whom filed expert reports and testified at deposition. Dr. Baron analyzed whether the HDMI license arrangement had procompetitive benefits, whether its licensing rates were supracompetitive, and whether the licensing agreement had caused antitrust injury. Dr. Zetenyi rebutted Availink’s expert’s claims regarding market definition, HDMI LA’s alleged market power, and whether the alleged misconduct restrained competition.

A judge in the US District Court for the Northern District of California granted HDMI LA’s motion for summary judgment. Referring to Dr. Zetenyi’s expert report at multiple points, the judge held that there was no evidence that HDMI LA’s licensing agreement had harmed competition or that Availink had suffered antitrust harm.

Pro Bono Testimony and Report of Vice President Kristof Zetenyi Supports Win for Unhoused Angelenos

Analysis Group provided pro bono services to the Legal Aid Foundation of Los Angeles (LAFLA) on behalf of civil rights groups and unhoused individuals in the greater Los Angeles area, the plaintiffs in litigation filed against the city of Los Angeles.

The matter, Janet Garcia, et al. v. The City of Los Angeles, centered on Los Angeles Municipal Code Section 56.11 (LAMC 56.11), which was codified to “balance the needs of all the City’s residents.” This provision was cited by the city to enact cleanups of unhoused residents’ encampments, which in some cases destroyed the property of unhoused residents. The plaintiffs alleged that the destruction of tents and other belongings necessary for survival under LAMC 56.11 violated their Fourth and Fourteenth Amendment rights because such destruction amounted to unreasonable seizures of personal property and deprived people of required due process. LAFLA argued that the city was legally required to store and return any seized property.

An Analysis Group team led by Vice President Owen Hearey and Advanced Analytics Specialist Varsha Sabhnani supported Vice President Kristof Zetenyi, who submitted an expert report and testified at deposition. Dr. Zetenyi analyzed data provided by the city to evaluate the extent to which unhoused residents’ property was stored or disposed of during cleanups and how often such property, when stored, was returned to its owners. In his report, Dr. Zetenyi found that in the vast majority of cleanups the city did not return any of the unhoused residents’ property or send such property to storage.

Judge Dale S. Fischer of the US District Court for the Central District of California ruled in favor of the plaintiffs, granting terminating sanctions against the city.

In a landmark antitrust matter, Meta (then known as Facebook) successfully defended itself against claims by the Federal Trade Commission (FTC) that it held a monopoly in the market for personal social networking (PSN) and that it maintained its dominant position by purchasing Instagram in 2012 and WhatsApp in 2014 to eliminate competition in the PSN market, in violation of the Sherman Act.

An Analysis Group team led by Managing Principal Aaron Yeater and Vice President David Toniatti was retained on behalf of Meta and supported Catherine Tucker, who testified at deposition and trial. Professor Tucker opined that the success of Meta’s advertising business was due to innovation in ad quality rather than to an exercise of market power. Judge James Boasberg of the US District Court for the District of Columbia determined that the acquisitions of Instagram and WhatsApp were not anticompetitive, giving Meta a complete victory. Judge Boasberg relied heavily on Professor Tucker’s trial testimony to support his finding that Meta’s advertising strategy was not evidence of anticompetitive conduct but, rather, of an improvement in advertising features and an increase in ad quality, setting a precedent for the evaluation of antitrust harm in markets with so-called “zero-price” products.

Analysis Group Experts Support Meta’s Successful Derivative Securities Settlement

Analysis Group was retained on behalf of individual directors of Meta Platforms (then Facebook) in a derivative securities litigation filed in the Delaware Court of Chancery. The plaintiffs claimed that Mark Zuckerberg and other Facebook directors breached their fiduciary duties by failing to adequately oversee compliance with a 2012 Federal Trade Commission (FTC) consent order related to users’ data privacy. The plaintiffs’ suit also included insider trading claims against Mark Zuckerberg.

Analysis Group Collaborates with Research Partners to Explore Disparities in Treatment of Patients with Chronic Spontaneous Urticaria

Chronic spontaneous urticaria (CSU) is a condition characterized by itching, hives, and tissue swelling lasting over six weeks without an identifiable trigger. The recommended first-line treatment for CSU is H1-antihistamines, and more advanced treatments, such as biologics, can provide targeted approaches to achieving clinical remission. Systemic corticosteroids (prescription medications that reduce inflammation) are recommended for short-term use during acute flare-ups, however frequent and/or prolonged use of systemic corticosteroids can result in serious adverse events (AEs). Despite such treatments, a large proportion of patients experience a prolonged disease journey and health inequities in the care CSU patients receive are not fully understood.

An Analysis Group team led by Vice President Irina Pivneva, Manager Jason Doran, and Associate Frederic Kinkead collaborated with researchers from Novartis on three posters on CSU presented at the American College of Allergy, Asthma & Immunology (ACAAI) 2025 Annual Scientific Meeting. Their research used data from a large US health insurance claims database to evaluate disparities in the management of CSU.

In the first poster, the researchers assessed the treatment patterns and health care resource utilization (HCRU) of CSU patients according to race and ethnicity and insurance coverage. The highest proportion of corticosteroid use and emergency room visits were among Black patients with Medicaid, suggesting more uncontrolled disease in this population. Despite this, only 10% of Black patients with Medicaid received advanced, or biologic, treatment, suggesting disparities in CSU management.

For the second poster, the team examined treatment patterns and HCRU in CSU patients according to specialist visits, including dermatologist and allergist visits. They observed that patients with both allergist and dermatologist visits received higher proportions of biologics as compared with other groups, and that patients who only visited an allergist had a higher degree of biologic use and a shorter wait time to initiate this advanced treatment option as compared with patients who only visited dermatologists or primary care physicians. The researchers observed a high proportion of patients with CSU-related corticosteroid use, inpatient admissions, and emergency room and urgent care visits, suggesting both a high level of uncontrolled disease across all groups and an unmet need for more effective treatment options.

In the third poster, the researchers described systemic corticosteroid use and its associated outcomes in CSU patients in the US. Corticosteroid use, they observed, was associated with the occurrence of adverse events (AEs) such as lipid disorders and hypertension, and prolonged use was generally associated with more frequent AEs and greater AE-related HCRU. The team concluded by noting that provider guidelines support restricting corticosteroids to short-term use and only as a rescue treatment for managing CSU.

The researchers concluded that, while more research is needed, disparities in CSU management do exist and there is an unmet need for more CSU treatment options.

Team of Analysis Group Consultants Considers the Costs and Benefits of a Sub-Annual Market for the PJM Region

For PJM Interconnection – a regional transmission organization (RTO) that coordinates wholesale electricity in 13 states and the District of Columbia – a team from Analysis Group completed a study of its capacity market as part of an effort to meet future power needs. The study was conducted in response to an issue charge brought by Pennsylvania Governor Josh Shapiro. According to the charge, PJM’s existing annual market auction structure was “suboptimal.” Furthermore, in order to account for accelerated demand growth since the implementation of PJM’s 2007 capacity market, “there is a pressing need to implement a sub-annual capacity model, which could provide ‘near-term achievable improvements to the market’s ability to meet resource adequacy requirements in an efficient, least-cost manner.’”

The Analysis Group team included Principal Todd Schatzki; Vice President Joseph Cavicchi; Manager Phillip Ross; Associates Dan Dychala, Claire Paoli, and Kirill Rudov; and Senior Analysts Aditya Acharya and Sanjam Chhabra. The team evaluated the potential benefits of a sub-annual market given PJM’s evolving loads and mix of generation resources, and assessed tradeoffs in sub-annual market design options. It also conducted a quantitative analysis using a capacity market simulation model, which estimated changes in prices, payments, production costs, and reliability under current and long-run market conditions.

The team identified multiple benefits to PJM from adopting a sub-annual market, including more accurate pricing to improve short-term resource allocation and long-term resource investment, more accurate accounting for resource and system features, improved alignment of resource compensation with performance, and greater flexibility in adapting to market conditions.

The study follows previous work by Analysis Group on New England’s RTO which includes the adopted recommendation to develop prompt and seasonal markets.
