<p>Arnstein &amp; Lehr Chicago Partner <a href="http://legalnews.arnstein.com/barry-a-chatz/">Barry A. Chatz</a> presented at the National Business Institute&#8217;s &#8220;Real Estate Foreclosure: A Step-by-Step Workshop&#8221; on January 13. He lead a discussion on the tax consequences of foreclosure. Mr. Chatz&#8217;s presentation included a review of the IRS reporting requirements for lender losses, the treatment of debt, the Mortgage Forgiveness Debt Relief Act, and the relief for investor owners of residential and commercial property. The workshop was geared for attorneys, mortgage brokers, in-house counsel and loan officers. Other topics covered during the full-day workshop included a case law update, alternatives to foreclosure, how bankruptcy changes the landscape and ethics in foreclosure. It was held at the Hyatt Lisle. Six hours of CLE credit has been approved by the Illinois MCLE board, including one hour of legal ethics CLE.</p>

Morse</a> have coauthored another article for Thomson Reuters News &amp; Insight, published on the Bankruptcy Law page on December 17. The article, titled “A step inside consumer bankruptcy,” examines issues affecting the administration of consumer bankruptcy cases and how the law is being applied in the consumer Chapter 7 and 13 contexts. Mr. Chatz and Mr. Morse comment on three issues: the retrieval of a debtor’s towed vehicle without having to pay the towing fee or for the bankruptcy filing; difficulties faced by Chapter 7 trustees and secured creditors when determining the value of property, who rely on a debtor’s schedules or imperfect internet sources; and the effect of the decrease used car price on the car financing market and on the lender’s ability to recover on its loan.</p>

<p>Arnstein &amp; Lehr Chicago Partner <a href="http://legalnews.arnstein.com/barry-a-chatz/">Barry A. Chatz</a> recently participated in a “virtual roundtable” about US bankruptcy issues. The report has been published in the October issue of Financier Worldwide Magazine. Mr. Chatz was 1 of 4 panelists answering questions from moderator James Markus, President of American Bankruptcy Institute. In response to a question regarding the current health of US corporations, Mr. Chatz commented that through the end of 2012, it appears that US corporations will continue to thrive or maintain the status quo, avoiding significant distress or stress; however certain pockets of stress will continue to linger, including the newspaper business and some areas of construction.</p>

Morse</a> authored an article for the September 10 issue of Thomson and Reuters News &amp; Insight, titled “Beware of your fruits and vegetables: The nondischargeability of PACA related debts in bankruptcy.” Mr. Chatz and Mr. Morse explain how Congress passed the Perishable Agricultural Commodities Act in 1930 to protect the interests of producers of fresh fruits and vegetables when they brought their products to market, and Congress’ 1980s creation of a floating PACA trust. Mr. Chatz and Mr. Morse comment on how the PACA trust has strengthened PACA’s enforcement for the producers, however since its passage it has come into conflict with the bankruptcy code and the individual debtor’s fresh start.</p>

Morse</a> authored an article for the July 6 issue of Thomson and Reuters News &amp; Insight, titled “After RadLAX: A practitioner’s guide.” Mr. Chatz and Mr. Morse discuss the case, RadLax Gateway Hotel LLC v. Amalgamated Bank, where the Supreme Court ruled that secured creditors have the right to bid their credit at an auction for their collateral. Mr. Chatz and Mr. Mrose comment on how the decision leaves debtors with fewer options during Chapter 11 reorganizations and ways for attorneys to represent debtors.</p>

The article, titled “BAPCPA and the middle class conundrum,” discusses the need for revisions to the Bankruptcy Code in order to give the middle class financial breathing room. Mr. Chatz and Mr. Morse suggest that certain government policies, such as the Means Test and the extended discharge period, have created “a virtual economic debtor prison incarcerating the middle class.”</p>

Marshall</em>: A narrow ruling creating broad problems in the bankruptcy process,” discusses the US Supreme Court’s decision in a case that may broadly impact the utilization of the bankruptcy process within Federal Courts for years to come. Barry and Kevin explain that the Courts and litigants are using the Stern case as a vehicle to challenge and manipulate the jurisdiction of bankruptcy courts and the bankruptcy process.</p>
